DISTANCE SERVICES AGREEMENT (EN)

1. Parties and Definitions

  • Service Provider (Hospital): Elite Research and Surgical Hospital Şht. Erdoğan Street, Kızılay, Nicosia / TRNC).
  • Service Receiver (Patient): The user/patient who selects and purchases one of the remote medical consultation, assessment, or prescription packages via the virtual POS channel on the website (or via secure payment links provided by the hospital).
  • Subject: This agreement regulates the terms, conditions, pricing, and obligations of the parties regarding the remote health consultation, medical document assessment, and prescription coordination services purchased electronically by the PATIENT and delivered via digital channels (Website, Email, WhatsApp, Viber, Telegram, etc.).

2. Service Packages and Pricing

The specific service packages available for purchase by the PATIENT via the Virtual POS, which are performed instantly in the electronic environment, along with their fixed fees, are listed below:

  • a) Prescription Fee: 70 EUR
    Includes only the formal preparation and electronic transmission of the medical prescription by the expert physician via digital communication channels, in accordance with the patient's current medical status or declarations.
  • b) Assessment and Prescription Fee: 180 Euros (EUR)
    Includes the professional review, comprehensive analysis, and clinical evaluation by an expert physician of any medical documents, laboratory test results, medical reports, epicrisis, or imaging data (such as X-Ray, MRI, CT scans) uploaded by the PATIENT directly onto the website OR transmitted digitally via the HOSPITAL’s official communication channels (including Email, WhatsApp, Viber, Telegram, or any other instant messaging and social communication platforms). Following this evaluation, the required medical prescription is prepared digitally and transmitted back to the PATIENT.
  • c) Online Consultation, Assessment and Prescription Fee: 360 Euros (EUR)
    Includes a live/online medical consultation (video or audio session via digital platforms such as WhatsApp, Viber, etc.) between the PATIENT and the physician, a comprehensive analysis of the patient's medical history/documents transmitted through digital channels, and the issuance of the required medical prescription based on the interactive consultation.

3. Medical Disclaimer and Limitations

⚠️ Critical Medical Disclaimer: Any review of documents, remote medical assessment, or prescription service conducted via the website, Email, or instant messaging platforms such as WhatsApp/Viber is strictly and solely based on the symptoms declared by the PATIENT and the validity, accuracy, and currency of the medical files transmitted through these digital channels. These services serve exclusively as preliminary medical guidance and remote consultation. A definitive clinical diagnosis, absolute determination, and final treatment protocol can only be established through a face-to-face physical examination conducted within Elite Hospital.

4. No-Refund Policy and Non-Applicability of the Right of Withdrawal

  • All services provided under this agreement (Prescription, Assessment, Online Consultation) constitute digital services and intangible goods that are performed instantly in the electronic environment and delivered to the PATIENT immediately through digital means.
  • According to international distance contract regulations and consumer protection laws, "contracts regarding services performed instantly in the electronic environment or intangible goods delivered immediately to the consumer" are strictly exempted from the right of withdrawal.
  • Consequently, once the PATIENT selects a package and the Virtual POS payment is approved, no cancellations, refunds, rollbacks, or modifications can be made. By completing the payment transaction, the PATIENT explicitly acknowledges and agrees that they waive any rights to a refund.

5. Communication Channels and Data Security

  • The PATIENT acknowledges and agrees that they share their medical documents via third-party digital infrastructures (WhatsApp, Viber, Email, etc.) of their own free will, and consents to data transmission through the servers of these channels. The HOSPITAL undertakes to keep all received data confidential in compliance with KVKK and GDPR standards.
  • The credit card/debit card information used by the PATIENT during payment is never stored or kept on the HOSPITAL's servers or databases. All payment transactions take place directly between the card-issuing bank/payment institution and the PATIENT via 256-Bit SSL certificate encryption and 3D Secure (Secure Payment Gateway).

6. International Patients & Customs/Regulatory Responsibilities

  • The legal validity of prescriptions or medical reports issued by the HOSPITAL according to the local legislation of the PATIENT's country of residence, the availability of medications from pharmacies in that country, or import/transit rules at customs border crossings are entirely the PATIENT'S responsibility. The HOSPITAL bears no responsibility if the PATIENT is unable to access medications due to local bureaucracy, customs, or regulatory restrictions in their own country, and this does not constitute grounds for return.

7. Effectiveness and Acceptance

  • By finalizing the checkout process and completing the payment transaction via the Virtual POS on the website or integrated communication links, the PATIENT acknowledges that they have thoroughly read, fully understood, and unconditionally agreed to all terms of this agreement, including the strict no-refund policy.
